ประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลของพนักงาน
(Employee Privacy Notice)
บทนำ
ประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลของพนักงาน (Employee Privacy Notice) มีผลใช้บังคับกับข้อมูลส่วนบุคคลของท่านที่ บริษัท เอก-ชัย ดีสทริบิวชั่น ซิสเทม จำกัด (“บริษัท”) เก็บรวบรวม และท่านตกลงให้บริษัทเก็บรวบรวม รักษา ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านทั้งที่มีอยู่แล้ว (ถ้ามี) ตลอดจนข้อมูลส่วนบุคคลของท่านที่บริษัทจะจัดเก็บในอนาคตภายใต้ข้อกำหนดและเงื่อนไขของประกาศฉบับนี้
บริษัทขอแนะนำให้ท่านทำความเข้าใจประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลของพนักงาน (Employee Privacy Notice) ฉบับนี้ เพื่ออธิบายให้ท่านทราบถึงวิธีการที่บริษัทปฏิบัติต่อข้อมูลส่วนบุคคลของท่าน เช่น วิธีการเก็บรวบรวม ใช้ เปิดเผย หรือการดำเนินการใด ๆ กับข้อมูลส่วนบุคคลไม่ว่าด้วยวิธีการอัตโนมัติหรือไม่ก็ตาม อาทิ การบันทึก การจัดระบบ การจัดเก็บ การปรับเปลี่ยนหรือการดัดแปลง การเรียกคืน การส่ง โอน การเผยแพร่ หรือการทำให้สามารถเข้าถึงหรือพร้อมใช้งานโดยวิธีใด ๆ รวมถึงการจัดเรียง การนำมารวมกัน การห้ามเข้าถึงหรือจำกัด การลบหรือการทำลาย (“ประมวลผล”) และเพื่อแจ้งให้ท่านทราบถึงวัตถุประสงค์ในการประมวลผล ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล ตลอดจนสิทธิของท่าน โดยมีรายละเอียดดังต่อไปนี้
1. ขอบเขตของประกาศ
ประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลฉบับนี้ครอบคลุมถึง พนักงานทุกประเภทตามสัญญาจ้างที่บริษัทกำหนด และบุคคลที่สามที่มีส่วนเกี่ยวข้องกับท่าน ได้แก่ บุคคลในครอบครัวของท่าน บุคคลที่ท่านได้เสนอให้เป็นบุคคลที่ติดต่อได้ในกรณีฉุกเฉิน หรือเสนอให้เป็นบุคคลที่ติดต่อเพื่อตรวจสอบประวัติก่อนเข้าทำงานกับบริษัท ทั้งนี้ เมื่อท่านได้เปิดเผยข้อมูลส่วนบุคคลของบุคคลที่สามดังกล่าวให้แก่บริษัท บริษัทจะถือว่าท่านมีสิทธิโดยชอบด้วยกฎหมาย หรือได้ขอความยินยอมในการเปิดเผยข้อมูลส่วนบุคคลจากบุคคลนั้น ๆ แล้ว
2. การเคารพสิทธิในความเป็นส่วนบุคคลของพนักงาน
บริษัทเคารพและให้ความสำคัญถึงสิทธิและการคุ้มครองข้อมูลส่วนบุคคลของท่าน และตระหนักดีว่าท่านในฐานะพนักงานของบริษัท ย่อมมีความประสงค์จะได้รับความมั่นคงปลอดภัยในข้อมูลส่วนบุคคลของท่าน โดยข้อมูลส่วนบุคคลดังกล่าวจะถูกนำไปใช้ตามวัตถุประสงค์การดำเนินงานของบริษัทเท่านั้น
นอกจากนี้ บริษัทจัดให้มีมาตรการในการรักษาความมั่นคงปลอดภัย ตลอดจนการป้องกันมิให้ผู้ที่มิได้รับอนุญาตเข้าถึงหรือนำข้อมูลส่วนบุคคลของท่านไปใช้โดยมิชอบ
กรณีที่บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้ก่อนวันที่กฎหมายมีผลบังคับใช้ บริษัทจะเก็บรวบรวม และใช้ข้อมูลส่วนบุคคลของท่านต่อไปตามวัตถุประสงค์เดิมที่บริษัทได้แจ้งไว้แก่ท่าน ทั้งนี้ ท่านมีสิทธิเพิกถอนความยินยอม โดยติดต่อมายังบริษัทตามรายละเอียดในข้อ 8 ของเอกสารฉบับนี้
3. วิธีที่บริษัทเก็บรวบรวมและรับข้อมูลส่วนบุคคลของท่าน
3.1. บริษัทเก็บรวบรวมและรับข้อมูลส่วนบุคคลของท่านผ่านช่องทางต่าง ๆ ดังนี้
(ก) ข้อมูลส่วนบุคคลที่ท่านให้ไว้กับบริษัทโดยตรง
ท่านอาจให้ข้อมูลส่วนบุคคลแก่บริษัทโดยตรง เช่น จากใบสมัครงาน สัญญาจ้าง และเอกสารหลักฐานอื่น ๆ ที่ท่านส่งมอบให้กับบริษัทตามกระบวนการสรรหา คัดเลือก และจ้างงาน โดยที่ท่านต้องให้ข้อมูลส่วนตัวของบุคคลอื่นด้วย ได้แก่ บุคคลในครอบครัว (บิดา มารดา คู่สมรส บุตร) บุคคลที่ติดต่อได้ในกรณีฉุกเฉิน และ/หรือบุคคลอ้างอิงท่านอื่น ๆ ซึ่งบริษัทใช้ข้อมูลเหล่านี้เพื่อดำเนินการและบริหารงานด้านงานบุคคล การจัดสิทธิสวัสดิการอันเป็นประโยชน์แก่ท่านในฐานะลูกจ้าง และ/หรือใช้ติดต่อในกรณีฉุกเฉิน เป็นต้น
(ข) ข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวมจากท่านโดยอัตโนมัติ
บริษัทอาจเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยอัตโนมัติผ่านช่องทางต่าง ๆ เช่น การใช้คุกกี้ (Cookies) หรือเทคโนโลยีอื่น ๆ ที่มีลักษณะคล้ายคลึงกัน
(ค) ข้อมูลส่วนบุคคลที่บริษัทได้รับมาจากบุคคลภายนอก
บริษัทอาจได้รับข้อมูลส่วนบุคคลของท่านมาจากบุคคลภายนอก เช่น บริษัทตัวแทนหางาน หรือองค์กรที่ให้บริการด้านการสรรหาบุคลากร (หากท่านสมัครงานผ่านบริษัทตัวแทนดังกล่าว โปรดทบทวนนโยบายความเป็นส่วนตัวที่จัดทำโดยบริษัทนั้น ๆ เพิ่มเติม), การขอข้อมูลอ้างอิงของท่าน จากเพื่อนร่วมงานหรือนายจ้างเดิมของท่าน, การเช็คประวัติส่วนตัวอื่น ๆ ภายในขอบเขตและตามวิธีการที่กฎหมายกำหนด, หรือจากบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ (รายชื่อบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ปรากฎตามเอกสารแนบ) เป็นต้น
3.2. ในการเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน ท่านจะได้รับการแจ้งถึงรายละเอียดต่าง ๆ ตามที่ระบุไว้ในประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคล (Privacy Notice) นี้ ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะฐานทางกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคล หรือหากเป็นกรณีที่กฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลกำหนดให้ต้องได้รับความยินยอมจากท่าน บริษัทจะขอความยินยอมโดยชัดแจ้งจากท่าน โดยจะประมวลผลข้อมูลส่วนบุคคลของท่านเมื่อท่านได้ให้ความยินยอมแก่บริษัทแล้ว
4. ข้อมูลส่วนบุคคล และวัตถุประสงค์ในการเก็บรวบรวม ใช้ เปิดเผย และประมวลผลข้อมูลส่วนบุคคล
4.1. ข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวม ได้แก่

บริษัทอาจรวบรวมและใช้ข้อมูลส่วนบุคคลเพิ่มเติม ทั้งนี้ขึ้นอยู่กับหน้าที่และความรับผิดชอบของพนักงานตามลักษณะงานที่ว่าจ้าง บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลที่มีความอ่อนไหวตามความยินยอมโดยขึ้นอยู่กับความสำคัญของข้อมูลอ่อนไหวนั้นต่อการปฏิบัติหน้าที่ของพนักงาน
บริษัทจะเก็บข้อมูลส่วนบุคคลตลอดจนเอกสารอันเป็นข้อมูลส่วนบุคคลของท่านไว้ตลอดระยะเวลาการเป็นลูกจ้าง เมื่อพ้นสภาพการเป็นลูกจ้างแล้ว บริษัทจะเก็บข้อมูลส่วนบุคคลไว้เป็นเวลา 10 ปี เว้นแต่กฎหมายอันเกี่ยวกับการจ้างงานได้กำหนดระยะเวลาการเก็บรักษาไว้เกินกว่าที่บริษัทกำหนด ก็ให้ทำการเก็บรักษาตามระยะเวลาที่กฎหมายดังกล่าวกำหนด หลังจากนั้นข้อมูลทั้งหมดของท่านจะเข้าสู่กระบวนการทำลายข้อมูลของบริษัทต่อไป
4.2. วัตถุประสงค์ในการเก็บรวบรวม ใช้ เปิดเผย และประมวลผลข้อมูลส่วนบุคคล
บริษัทอาศัยฐานประโยชน์โดยชอบด้วยกฎหมาย หน้าที่ตามกฎหมาย สัญญา และความยินยอม ในการประมวลผลข้อมูลส่วนบุคคล สำหรับข้อมูลส่วนบุคคลอ่อนไหว บริษัทใช้ฐานความยินยอม ยกเว้นเงื่อนไขบางประการที่กำหนดโดยพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล

เนื่องจากข้อมูลส่วนบุคคลของท่านที่บริษัทจะดำเนินการประมวลผลตามวัตถุประสงค์ข้างต้นในส่วนที่เกี่ยวเนื่องกับการปฏิบัติตามกฎหมายหรือสัญญา หรือมีความจำเป็นเพื่อเข้าทำสัญญากับท่าน เป็นข้อมูลที่จำเป็นต่อการบรรลุวัตถุประสงค์ดังกล่าว หากท่านไม่ประสงค์ที่จะให้ข้อมูลส่วนบุคคลดังกล่าวแก่บริษัท อาจมีผลกระทบทางกฎหมาย หรือบริษัทอาจไม่สามารถปฏิบัติหน้าที่ภายใต้สัญญากับท่าน หรือไม่สามารถทำสัญญากับท่านได้ (แล้วแต่กรณี) และบริษัทอาจมีความจำเป็นต้องปฏิเสธการเข้าทำสัญญากับท่าน หรือยกเลิกการให้บริการที่เกี่ยวข้องต่อท่าน ไม่ว่าทั้งหมดหรือบางส่วน
ในกรณีที่บริษัทจะดำเนินการประมวลผลข้อมูลส่วนบุคคลของท่านในลักษณะ และ/หรือวัตถุประสงค์ที่ไม่ตรงหรือสอดคล้องกับที่ระบุไว้ข้างต้น บริษัทจะจัดให้มีนโยบายหรือประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคล (Privacy Notice) เพิ่มเติม เพื่ออธิบายการประมวลผลข้อมูลในลักษณะดังกล่าว
5. หน่วยงานที่ข้อมูลส่วนบุคคลอาจถูกเปิดเผย
เพื่อการปฏิบัติตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลข้างต้น บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านไปยัง
1. บริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ (รายละเอียดรายชื่อบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ปรากฎตามเอกสารแนบ)
2. หน่วยงานภายนอกเครือเจริญโภคภัณฑ์ที่เกี่ยวข้องกับการจ้างงานและการจัดสิทธิสวัสดิการของพนักงาน เช่น บริษัทประกันภัย บริษัทจัดทำนามบัตรพนักงานให้กับบริษัท บริษัทจัดทำบัตรพนักงานให้กับบริษัท ธนาคารที่ท่านเปิดบัญชีเงินเดือน โรงพยาบาลหรือสถานพยาบาลตามระเบียบสวัสดิการค่ารักษาพยาบาลที่บริษัทกำหนด องค์กรภาครัฐ เป็นต้น
การเปิดเผยข้อมูลส่วนบุคคลของท่านให้กับบุคคลอื่น บริษัทจะดำเนินการภายใต้วัตถุประสงค์ที่กำหนด หรือวัตถุประสงค์อื่นที่กฎหมายกำหนดให้กระทำได้เท่านั้น ในกรณีที่กฎหมายกำหนดว่าต้องได้รับความยินยอมจากท่าน บริษัทจะดำเนินการขอความยินยอมจากท่านก่อนการเปิดเผยข้อมูลส่วนบุคคลดังกล่าว
กรณีที่บริษัทเปิดเผยข้อมูลส่วนบุคคลของท่านให้บุคคลอื่น บริษัทจะจัดให้มีมาตรการที่เหมาะสมเพื่อคุ้มครองข้อมูลส่วนบุคคลที่ได้เปิดเผยและเพื่อปฏิบัติตามมาตรฐานและหน้าที่การคุ้มครองข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด และในกรณีที่บริษัทส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ บริษัทจะดำเนินการเพื่อทำให้แน่ใจว่าประเทศปลายทาง องค์การระหว่างประเทศ หรือผู้รับข้อมูลในต่างประเทศนั้นมีมาตรการในการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ โดยในบางกรณี บริษัทอาจขอความยินยอมของท่านสำหรับการส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ ทั้งนี้ ตามที่กฎหมายกำหนด
6. ระยะเวลาเก็บรักษาข้อมูลส่วนบุคคล
บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านตามระยะเวลาที่จำเป็นเพื่อบรรลุวัตถุประสงค์ที่กำหนดในการประมวลผลข้อมูลส่วนบุคคลนั้น ๆ โดยระยะเวลาเก็บรักษาข้อมูลส่วนบุคคลจะเปลี่ยนแปลงไปขึ้นอยู่กับวัตถุประสงค์ที่กำหนดในการเก็บรวบรวมข้อมูลส่วนบุคคล นอกจากนี้ บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลตามระยะเวลาที่กฎหมายที่เกี่ยวข้องกำหนด และโดยคำนึงถึงแนวปฏิบัติทางธุรกิจสำหรับแต่ละประเภทของข้อมูลส่วนบุคคล
7. สิทธิของเจ้าของข้อมูลส่วนบุคคล
7.1. สิทธิที่จะเพิกถอนความยินยอม
ท่านสามารถถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านได้ ในกรณีที่ท่านได้ให้ความยินยอมแก่บริษัทในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน
7.2. สิทธิในการเข้าถึงข้อมูลส่วนบุคคล
ท่านสามารถเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่อยู่ในความรับผิดชอบของบริษัทได้ รวมถึงขอให้บริษัทเปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลดังกล่าว
7.3. สิทธิในการโอนย้ายข้อมูลส่วนบุคคล
ท่านมีสิทธิที่จะขอให้ส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น หรือตัวท่านเอง เว้นแต่โดยสภาพไม่สามารถทำได้ ทั้งนี้ ตามที่กฎหมายกำหนด
7.4. สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคล
ท่านสามารถขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ในกรณีดังต่อไปนี้
7.4.1. บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยได้รับยกเว้นไม่ต้องขอความยินยอม เนื่องจากเป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐตามที่ได้รับมอบหมาย หรือเป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัท เว้นแต่ บริษัทมีเหตุอันชอบด้วยกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้น หรือเป็นไปเพื่อการก่อตั้ง ปฏิบัติตาม ใช้หรือยกขึ้นต่อสู้ซึ่งสิทธิเรียกร้องตามกฎหมาย
7.4.2. บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
7.4.3. บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ เว้นแต่เป็นการจำเป็นเพื่อการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท
7.5. สิทธิในการลบข้อมูลส่วนบุคคล
ท่านสามารถขอให้บริษัทลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลส่วนบุคคล ในกรณีดังต่อไปนี้
7.5.1. เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
7.5.2. เมื่อท่านถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่มีอำนาจตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลได้ต่อไป
7.5.3. เมื่อท่านคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่อาจปฏิเสธคำขอ
7.5.4. เมื่อข้อมูลส่วนบุคคลได้ถูกเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย
7.6. สิทธิในการระงับการใช้ข้อมูลส่วนบุคคล
ท่านสามารถขอให้บริษัทระงับการใช้ขอมูลส่วนบุคคลของท่าน ในกรณีดังต่อไปนี้
7.6.1. เมื่อบริษัทอยู่ระหว่างการตรวจสอบความเป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิดของข้อมูลส่วนบุคคล
7.6.2. เมื่อข้อมูลส่วนบุคคลของท่านเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย
7.6.3. เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
7.6.4. เมื่อบริษัทอยู่ระหว่างการพิสูจน์ หรือตรวจสอบเพื่อปฏิเสธคำขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านตามข้อ 7.4
7.7. สิทธิในการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง
ท่านสามารถตรวจสอบได้ว่าข้อมูลส่วนบุคคลของท่านมีความเป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด และหากท่านเห็นว่าข้อมูลส่วนบุคคลใดที่เกี่ยวกับท่านไม่เป็นปัจจุบัน ไม่สมบูรณ์ หรือก่อให้เกิดความเข้าใจผิด ท่านสามารถขอแก้ไข เปลี่ยนแปลง หรือลบข้อมูลส่วนบุคคลนั้นได้
7.8. สิทธิในการยื่นข้อร้องเรียน
กรณีที่ท่านพบ เห็นการละเมิดหรือฝ่าฝืนนโยบายคุ้มครองข้อมูลส่วนบุคคลของบริษัท หรือเอกสารฉบับนี้ ท่านสามารถแจ้งเหตุการละเมิดหรือฝ่าฝืนได้ที่ ผู้ควบคุมข้อมูลส่วนบุคคล (Data Controller) ทางอีเมล [email protected] นอกจากนี้ ท่านยังมีสิทธิร้องเรียนกรณีฝ่าฝืนหรือไม่ปฏิบัติตาม พ.ร.บ.คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลตามหลักเกณฑ์ที่กฎหมายกำหนด
ทั้งนี้ ท่านสามารถใช้สิทธิในข้อ 7.1-7.8 ได้โดยการกรอกแบบฟอร์มคำร้องขอใช้สิทธิของเจ้าของข้อมูลและส่งมายังบริษัทตามช่องทางการติดต่อทางอีเมลที่ระบุในข้อ 8 หรือช่องทางอื่นใดตามที่บริษัทจะสื่อสารให้ทราบ ทั้งนี้ กรณีขอเพิกถอนความยินยอมบางประการ หรือแก้ไขข้อมูลส่วนบุคคลในเบื้องต้น ท่านสามารถเข้าไปดำเนินการผ่านระบบ iTouch ได้

Employee Privacy Notice
Preamble
This Employee Privacy Notice is applied to your personal data collected by Ek-Chai Distribution System Co., Ltd. (the “Company”) including existing personal data that you agreed to the Company to collect, use and disclose (if any) and any personal data to be collected in the future under conditions of this notice.
The Company recommend you to read and understand this Employee Privacy Notice as it explains you how the Company handles with your personal data including how to collect, use, disclose or other method, whether automatically or not, such as to record, manage system, retain, modify or transform, retrieve, transmit, transfer, disclose or make data usable or accessible, sort, combine, prohibit or limit access, delete or destroy (“Process”) and informs you for the purpose of Process, retention period of your personal data and your rights as details below.
1. Scope of this Employee Privacy Notice
This notice applies to all types of employees and third-party which relates to you such as your family members, emergency contact persons, reference persons. In addition, if you disclose the third-party’s personal data to the Company, it shall be deemed that you have already complied with the applicable law including receipt of consent from the third-party.
2. Respect of Employee’s Privacy
The Company respects of your privacy, concerns of your personal data protection and is aware that you, as the Company’s employee, may expect that your personal data shall be secured and used as the Company’s purpose only.
In addition, the Company has the measure for information security including protecting unauthorized persons to access or use of your personal data unlawfully.
In the event of your personal data collected prior the effectiveness of the law, the Company will collect and use your personal data in accordance with the same purposes announced to you. In this regard, you have the right to withdraw your consent by contacting the Company as details set out in Clause 8 of this document.
3. Collection and Receipt of Your Personal Data
3.1. The Company collects and receives your personal data from the following channels:
(a) Personal data that you directly disclose to the Company
You may disclosure your personal data to the Company directly such as application form, employment agreement and other supporting documents which you deliver to the Company at the stage of job application. In this regard, you may disclose third-party’s personal data such as family members (father, mother, spouse, children), emergency contact persons, and/or reference persons. The Company use these data for human resource management, providing privileges to you as the Company’s employee and/or contacting in case of emergency.
(b) Personal data that the Company automatically collects from you
The Company collects your personal data automatically through various channels such as Cookies or other similar technology.
(c) Personal data received from third-party
The Company may receive your personal data from third-party including recruitment agency (If you apply the job from the recruitment agency, please also read the recruitment agency’s privacy notice.), ex-colleague or ex-employer, verification of your profile by lawfully applicable method, or other companies under Charoen Pokphand Group (details thereof mentioned in the list of Charoen Pokphand Group attached herewith).
3.2. In case of collecting your personal data, the purpose and details as set out in this privacy notice shall be informed to you including without limitation to legal basis for collecting, using or disclosing and/or Process of personal data. If your prior consent is required, the Company will request for your consent expressly and will Process of your personal data once the Company receives your consent.

In case that your job description is required more personal data to be Processed, the Company may collect and use additional personal data. The Company may collect sensitive data by requesting your prior consent for the purpose of employment.
The Company collects your personal data including your documents having personal data during your employment and 10 years after your termination of employment unless the law specifies longer period to retain. After the retention period passes, your personal data will be destroyed in accordance with the Company’s process.
4.2. Purpose for collecting, using, disclosing and Process of personal data
The Company may refer to legitimate interest, legal obligation, contract and consent basis for Process of your personal data. For Process of sensitive data, the Company will refer to consent basis unless the exception specifies in Personal Data Protection Law.

The Company is required to Process your personal data for some purposes referred to legal basis (legal obligation or contract). If you do not want the Company to Process your personal data, there might be legal affects or the Company may be unable to perform the obligation under the contract or may not engage you (if any) resulting in the Company rejects to enter into the contract with you or cancel the services provided to you whether wholly or partially.
In the event that any Process of your personal data is different from the purposes as mentioned above, the Company will revise and announce the updated privacy notice to explain such new Process.
5. Disclosure of Personal Data to Third-Party
To comply with the purpose of collection, use and/or disclosure of the above matters, the Company may disclose your personal data to
1. Companies under Charoen Pokphand Group (Lists of companies under Charoen Pokphand Group are in the attachment.)
2. Outside organization related to the employment and employees’ welfare such as insurance company, company making employee’s card or name card, bank which you use for payroll, hospital or clinic for medical expenses provided by the Company, and government agency.
The disclosure of your personal data to third-party will be complied with the purposes specified by the Company or by law. In case that the law requires your consent, the Company will request for your consent prior disclosure of your personal data.
If the Company discloses your personal data to third-party, the Company will have the suitable measurement in accordance with the law to protect your disclosed personal data. In addition, if the Company transmits or transfers your personal data outside Thailand, the Company will ensure that the destination country, international organization or receiving person living outside Thailand has the sufficient measurement to protect your personal data. In some cases, the Company may request your consent prior transmission or transfer of your personal data outside Thailand.
6. Retention Period for Collecting of Personal Data
The Company retains your personal data only to achieve the specified purpose of Process. The retention period may be changed depending on the purpose of collecting personal data. In addition, the Company will collect the personal data as long as the law specified and business purpose.
7. Right of Data Subject
7.1. Right to withdraw consent
If you provide consent to collect, use, or disclose of your personal data, you have right to withdraw such consent.
7.2. Right to access personal data
You have right to request for access and receipt of your personal data collected by the Company including request to disclose how to receive such data.
7.3. Right to transfer personal data
You have right to request for transmission or transfer of your personal data to you or other data controllers unless the transmission or transfer cannot be done subject to the law.
7.4. Right to object for Process of personal data
You have right to object to collect, use and disclose of your personal data as the following circumstances:
7.4.1. The Company collects your personal data with the exemption to consent requirements as the purpose of use is for public interest, legal obligation, or legitimate interest unless the Company has a compelling legitimate ground to Process or the Company’s collection, use or disclosure of such personal data is carried out for the establishment, compliance or exercise of legal claims, or defense of legal claims.
7.4.2. The Company collects, uses, or discloses your personal data for direct marketing.
7.4.3. The Company collects, uses, or discloses your personal data for scientific, historical or statistic, unless it is necessary to performance of a task carried out or reasons of public interest by the Company.
7.5. Right to erase personal data
You have right to request for deletion, destroy or de-identification of your personal data for the following circumstances:
7.5.1. Your personal data is no longer necessary in relation to the purposes for which it was collected, used, or disclosed.
7.5.2. You have withdrawn consent on which the collection, use or disclosure is based on, and where the Company has no legal basis for such collection, use or disclosure.
7.5.3. You have successfully made an objection to collect, use or disclose of your personal data and the Company cannot reject to such request.
7.5.4. Your personal data have unlawfully Processed.
7.6. Right to restrict use of personal data
You have right to restrict the use of your personal data for the following circumstances:
7.6.1. The Company is in the process of investigation of the validity or accuracy of data.
7.6.2. Your personal data has been unlawfully collected, used, or disclosed.
7.6.3. Your personal data is no longer necessary to retain for the purpose of collection, used, or disclosure under this notice.
7.6.4. The Company is in the process to verify your request to reject the objection to collect, use or disclose your personal data as mentioned in clause 7.4.
7.7. Right to rectify your personal data

บทนำ
ประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลของพนักงาน (Employee Privacy Notice) มีผลใช้บังคับกับข้อมูลส่วนบุคคลของท่านที่ บริษัท เอก-ชัย ดีสทริบิวชั่น ซิสเทม จำกัด (“บริษัท”) เก็บรวบรวม และท่านตกลงให้บริษัทเก็บรวบรวม รักษา ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านทั้งที่มีอยู่แล้ว (ถ้ามี) ตลอดจนข้อมูลส่วนบุคคลของท่านที่บริษัทจะจัดเก็บในอนาคตภายใต้ข้อกำหนดและเงื่อนไขของประกาศฉบับนี้
บริษัทขอแนะนำให้ท่านทำความเข้าใจประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลของพนักงาน (Employee Privacy Notice) ฉบับนี้ เพื่ออธิบายให้ท่านทราบถึงวิธีการที่บริษัทปฏิบัติต่อข้อมูลส่วนบุคคลของท่าน เช่น วิธีการเก็บรวบรวม ใช้ เปิดเผย หรือการดำเนินการใด ๆ กับข้อมูลส่วนบุคคลไม่ว่าด้วยวิธีการอัตโนมัติหรือไม่ก็ตาม อาทิ การบันทึก การจัดระบบ การจัดเก็บ การปรับเปลี่ยนหรือการดัดแปลง การเรียกคืน การส่ง โอน การเผยแพร่ หรือการทำให้สามารถเข้าถึงหรือพร้อมใช้งานโดยวิธีใด ๆ รวมถึงการจัดเรียง การนำมารวมกัน การห้ามเข้าถึงหรือจำกัด การลบหรือการทำลาย (“ประมวลผล”) และเพื่อแจ้งให้ท่านทราบถึงวัตถุประสงค์ในการประมวลผล ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล ตลอดจนสิทธิของท่าน โดยมีรายละเอียดดังต่อไปนี้
1. ขอบเขตของประกาศ
ประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคลฉบับนี้ครอบคลุมถึง พนักงานทุกประเภทตามสัญญาจ้างที่บริษัทกำหนด และบุคคลที่สามที่มีส่วนเกี่ยวข้องกับท่าน ได้แก่ บุคคลในครอบครัวของท่าน บุคคลที่ท่านได้เสนอให้เป็นบุคคลที่ติดต่อได้ในกรณีฉุกเฉิน หรือเสนอให้เป็นบุคคลที่ติดต่อเพื่อตรวจสอบประวัติก่อนเข้าทำงานกับบริษัท ทั้งนี้ เมื่อท่านได้เปิดเผยข้อมูลส่วนบุคคลของบุคคลที่สามดังกล่าวให้แก่บริษัท บริษัทจะถือว่าท่านมีสิทธิโดยชอบด้วยกฎหมาย หรือได้ขอความยินยอมในการเปิดเผยข้อมูลส่วนบุคคลจากบุคคลนั้น ๆ แล้ว
2. การเคารพสิทธิในความเป็นส่วนบุคคลของพนักงาน
บริษัทเคารพและให้ความสำคัญถึงสิทธิและการคุ้มครองข้อมูลส่วนบุคคลของท่าน และตระหนักดีว่าท่านในฐานะพนักงานของบริษัท ย่อมมีความประสงค์จะได้รับความมั่นคงปลอดภัยในข้อมูลส่วนบุคคลของท่าน โดยข้อมูลส่วนบุคคลดังกล่าวจะถูกนำไปใช้ตามวัตถุประสงค์การดำเนินงานของบริษัทเท่านั้น
นอกจากนี้ บริษัทจัดให้มีมาตรการในการรักษาความมั่นคงปลอดภัย ตลอดจนการป้องกันมิให้ผู้ที่มิได้รับอนุญาตเข้าถึงหรือนำข้อมูลส่วนบุคคลของท่านไปใช้โดยมิชอบ
กรณีที่บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้ก่อนวันที่กฎหมายมีผลบังคับใช้ บริษัทจะเก็บรวบรวม และใช้ข้อมูลส่วนบุคคลของท่านต่อไปตามวัตถุประสงค์เดิมที่บริษัทได้แจ้งไว้แก่ท่าน ทั้งนี้ ท่านมีสิทธิเพิกถอนความยินยอม โดยติดต่อมายังบริษัทตามรายละเอียดในข้อ 8 ของเอกสารฉบับนี้
3. วิธีที่บริษัทเก็บรวบรวมและรับข้อมูลส่วนบุคคลของท่าน
3.1. บริษัทเก็บรวบรวมและรับข้อมูลส่วนบุคคลของท่านผ่านช่องทางต่าง ๆ ดังนี้
(ก) ข้อมูลส่วนบุคคลที่ท่านให้ไว้กับบริษัทโดยตรง
ท่านอาจให้ข้อมูลส่วนบุคคลแก่บริษัทโดยตรง เช่น จากใบสมัครงาน สัญญาจ้าง และเอกสารหลักฐานอื่น ๆ ที่ท่านส่งมอบให้กับบริษัทตามกระบวนการสรรหา คัดเลือก และจ้างงาน โดยที่ท่านต้องให้ข้อมูลส่วนตัวของบุคคลอื่นด้วย ได้แก่ บุคคลในครอบครัว (บิดา มารดา คู่สมรส บุตร) บุคคลที่ติดต่อได้ในกรณีฉุกเฉิน และ/หรือบุคคลอ้างอิงท่านอื่น ๆ ซึ่งบริษัทใช้ข้อมูลเหล่านี้เพื่อดำเนินการและบริหารงานด้านงานบุคคล การจัดสิทธิสวัสดิการอันเป็นประโยชน์แก่ท่านในฐานะลูกจ้าง และ/หรือใช้ติดต่อในกรณีฉุกเฉิน เป็นต้น
(ข) ข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวมจากท่านโดยอัตโนมัติ
บริษัทอาจเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยอัตโนมัติผ่านช่องทางต่าง ๆ เช่น การใช้คุกกี้ (Cookies) หรือเทคโนโลยีอื่น ๆ ที่มีลักษณะคล้ายคลึงกัน
(ค) ข้อมูลส่วนบุคคลที่บริษัทได้รับมาจากบุคคลภายนอก
บริษัทอาจได้รับข้อมูลส่วนบุคคลของท่านมาจากบุคคลภายนอก เช่น บริษัทตัวแทนหางาน หรือองค์กรที่ให้บริการด้านการสรรหาบุคลากร (หากท่านสมัครงานผ่านบริษัทตัวแทนดังกล่าว โปรดทบทวนนโยบายความเป็นส่วนตัวที่จัดทำโดยบริษัทนั้น ๆ เพิ่มเติม), การขอข้อมูลอ้างอิงของท่าน จากเพื่อนร่วมงานหรือนายจ้างเดิมของท่าน, การเช็คประวัติส่วนตัวอื่น ๆ ภายในขอบเขตและตามวิธีการที่กฎหมายกำหนด, หรือจากบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ (รายชื่อบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ปรากฎตามเอกสารแนบ) เป็นต้น
3.2. ในการเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน ท่านจะได้รับการแจ้งถึงรายละเอียดต่าง ๆ ตามที่ระบุไว้ในประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคล (Privacy Notice) นี้ ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะฐานทางกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคล หรือหากเป็นกรณีที่กฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลกำหนดให้ต้องได้รับความยินยอมจากท่าน บริษัทจะขอความยินยอมโดยชัดแจ้งจากท่าน โดยจะประมวลผลข้อมูลส่วนบุคคลของท่านเมื่อท่านได้ให้ความยินยอมแก่บริษัทแล้ว
4. ข้อมูลส่วนบุคคล และวัตถุประสงค์ในการเก็บรวบรวม ใช้ เปิดเผย และประมวลผลข้อมูลส่วนบุคคล
4.1. ข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวม ได้แก่

บริษัทอาจรวบรวมและใช้ข้อมูลส่วนบุคคลเพิ่มเติม ทั้งนี้ขึ้นอยู่กับหน้าที่และความรับผิดชอบของพนักงานตามลักษณะงานที่ว่าจ้าง บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลที่มีความอ่อนไหวตามความยินยอมโดยขึ้นอยู่กับความสำคัญของข้อมูลอ่อนไหวนั้นต่อการปฏิบัติหน้าที่ของพนักงาน
บริษัทจะเก็บข้อมูลส่วนบุคคลตลอดจนเอกสารอันเป็นข้อมูลส่วนบุคคลของท่านไว้ตลอดระยะเวลาการเป็นลูกจ้าง เมื่อพ้นสภาพการเป็นลูกจ้างแล้ว บริษัทจะเก็บข้อมูลส่วนบุคคลไว้เป็นเวลา 10 ปี เว้นแต่กฎหมายอันเกี่ยวกับการจ้างงานได้กำหนดระยะเวลาการเก็บรักษาไว้เกินกว่าที่บริษัทกำหนด ก็ให้ทำการเก็บรักษาตามระยะเวลาที่กฎหมายดังกล่าวกำหนด หลังจากนั้นข้อมูลทั้งหมดของท่านจะเข้าสู่กระบวนการทำลายข้อมูลของบริษัทต่อไป
4.2. วัตถุประสงค์ในการเก็บรวบรวม ใช้ เปิดเผย และประมวลผลข้อมูลส่วนบุคคล
บริษัทอาศัยฐานประโยชน์โดยชอบด้วยกฎหมาย หน้าที่ตามกฎหมาย สัญญา และความยินยอม ในการประมวลผลข้อมูลส่วนบุคคล สำหรับข้อมูลส่วนบุคคลอ่อนไหว บริษัทใช้ฐานความยินยอม ยกเว้นเงื่อนไขบางประการที่กำหนดโดยพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล

เนื่องจากข้อมูลส่วนบุคคลของท่านที่บริษัทจะดำเนินการประมวลผลตามวัตถุประสงค์ข้างต้นในส่วนที่เกี่ยวเนื่องกับการปฏิบัติตามกฎหมายหรือสัญญา หรือมีความจำเป็นเพื่อเข้าทำสัญญากับท่าน เป็นข้อมูลที่จำเป็นต่อการบรรลุวัตถุประสงค์ดังกล่าว หากท่านไม่ประสงค์ที่จะให้ข้อมูลส่วนบุคคลดังกล่าวแก่บริษัท อาจมีผลกระทบทางกฎหมาย หรือบริษัทอาจไม่สามารถปฏิบัติหน้าที่ภายใต้สัญญากับท่าน หรือไม่สามารถทำสัญญากับท่านได้ (แล้วแต่กรณี) และบริษัทอาจมีความจำเป็นต้องปฏิเสธการเข้าทำสัญญากับท่าน หรือยกเลิกการให้บริการที่เกี่ยวข้องต่อท่าน ไม่ว่าทั้งหมดหรือบางส่วน
ในกรณีที่บริษัทจะดำเนินการประมวลผลข้อมูลส่วนบุคคลของท่านในลักษณะ และ/หรือวัตถุประสงค์ที่ไม่ตรงหรือสอดคล้องกับที่ระบุไว้ข้างต้น บริษัทจะจัดให้มีนโยบายหรือประกาศแจ้งข้อมูลการประมวลผลข้อมูลส่วนบุคคล (Privacy Notice) เพิ่มเติม เพื่ออธิบายการประมวลผลข้อมูลในลักษณะดังกล่าว
5. หน่วยงานที่ข้อมูลส่วนบุคคลอาจถูกเปิดเผย
เพื่อการปฏิบัติตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลข้างต้น บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านไปยัง
1. บริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ (รายละเอียดรายชื่อบริษัทในกลุ่มธุรกิจภายใต้เครือเจริญโภคภัณฑ์ปรากฎตามเอกสารแนบ)
2. หน่วยงานภายนอกเครือเจริญโภคภัณฑ์ที่เกี่ยวข้องกับการจ้างงานและการจัดสิทธิสวัสดิการของพนักงาน เช่น บริษัทประกันภัย บริษัทจัดทำนามบัตรพนักงานให้กับบริษัท บริษัทจัดทำบัตรพนักงานให้กับบริษัท ธนาคารที่ท่านเปิดบัญชีเงินเดือน โรงพยาบาลหรือสถานพยาบาลตามระเบียบสวัสดิการค่ารักษาพยาบาลที่บริษัทกำหนด องค์กรภาครัฐ เป็นต้น
การเปิดเผยข้อมูลส่วนบุคคลของท่านให้กับบุคคลอื่น บริษัทจะดำเนินการภายใต้วัตถุประสงค์ที่กำหนด หรือวัตถุประสงค์อื่นที่กฎหมายกำหนดให้กระทำได้เท่านั้น ในกรณีที่กฎหมายกำหนดว่าต้องได้รับความยินยอมจากท่าน บริษัทจะดำเนินการขอความยินยอมจากท่านก่อนการเปิดเผยข้อมูลส่วนบุคคลดังกล่าว
กรณีที่บริษัทเปิดเผยข้อมูลส่วนบุคคลของท่านให้บุคคลอื่น บริษัทจะจัดให้มีมาตรการที่เหมาะสมเพื่อคุ้มครองข้อมูลส่วนบุคคลที่ได้เปิดเผยและเพื่อปฏิบัติตามมาตรฐานและหน้าที่การคุ้มครองข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด และในกรณีที่บริษัทส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ บริษัทจะดำเนินการเพื่อทำให้แน่ใจว่าประเทศปลายทาง องค์การระหว่างประเทศ หรือผู้รับข้อมูลในต่างประเทศนั้นมีมาตรการในการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ โดยในบางกรณี บริษัทอาจขอความยินยอมของท่านสำหรับการส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ ทั้งนี้ ตามที่กฎหมายกำหนด
6. ระยะเวลาเก็บรักษาข้อมูลส่วนบุคคล
บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านตามระยะเวลาที่จำเป็นเพื่อบรรลุวัตถุประสงค์ที่กำหนดในการประมวลผลข้อมูลส่วนบุคคลนั้น ๆ โดยระยะเวลาเก็บรักษาข้อมูลส่วนบุคคลจะเปลี่ยนแปลงไปขึ้นอยู่กับวัตถุประสงค์ที่กำหนดในการเก็บรวบรวมข้อมูลส่วนบุคคล นอกจากนี้ บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลตามระยะเวลาที่กฎหมายที่เกี่ยวข้องกำหนด และโดยคำนึงถึงแนวปฏิบัติทางธุรกิจสำหรับแต่ละประเภทของข้อมูลส่วนบุคคล
7. สิทธิของเจ้าของข้อมูลส่วนบุคคล
7.1. สิทธิที่จะเพิกถอนความยินยอม
ท่านสามารถถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านได้ ในกรณีที่ท่านได้ให้ความยินยอมแก่บริษัทในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน
7.2. สิทธิในการเข้าถึงข้อมูลส่วนบุคคล
ท่านสามารถเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่อยู่ในความรับผิดชอบของบริษัทได้ รวมถึงขอให้บริษัทเปิดเผยถึงการได้มาซึ่งข้อมูลส่วนบุคคลดังกล่าว
7.3. สิทธิในการโอนย้ายข้อมูลส่วนบุคคล
ท่านมีสิทธิที่จะขอให้ส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น หรือตัวท่านเอง เว้นแต่โดยสภาพไม่สามารถทำได้ ทั้งนี้ ตามที่กฎหมายกำหนด
7.4. สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคล
ท่านสามารถขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ในกรณีดังต่อไปนี้
7.4.1. บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยได้รับยกเว้นไม่ต้องขอความยินยอม เนื่องจากเป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐตามที่ได้รับมอบหมาย หรือเป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัท เว้นแต่ บริษัทมีเหตุอันชอบด้วยกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลนั้น หรือเป็นไปเพื่อการก่อตั้ง ปฏิบัติตาม ใช้หรือยกขึ้นต่อสู้ซึ่งสิทธิเรียกร้องตามกฎหมาย
7.4.2. บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
7.4.3. บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ เว้นแต่เป็นการจำเป็นเพื่อการดำเนินภารกิจเพื่อประโยชน์สาธารณะของบริษัท
7.5. สิทธิในการลบข้อมูลส่วนบุคคล
ท่านสามารถขอให้บริษัทลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลส่วนบุคคล ในกรณีดังต่อไปนี้
7.5.1. เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
7.5.2. เมื่อท่านถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่มีอำนาจตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลได้ต่อไป
7.5.3. เมื่อท่านคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทไม่อาจปฏิเสธคำขอ
7.5.4. เมื่อข้อมูลส่วนบุคคลได้ถูกเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย
7.6. สิทธิในการระงับการใช้ข้อมูลส่วนบุคคล
ท่านสามารถขอให้บริษัทระงับการใช้ขอมูลส่วนบุคคลของท่าน ในกรณีดังต่อไปนี้
7.6.1. เมื่อบริษัทอยู่ระหว่างการตรวจสอบความเป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิดของข้อมูลส่วนบุคคล
7.6.2. เมื่อข้อมูลส่วนบุคคลของท่านเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย
7.6.3. เมื่อข้อมูลส่วนบุคคลหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
7.6.4. เมื่อบริษัทอยู่ระหว่างการพิสูจน์ หรือตรวจสอบเพื่อปฏิเสธคำขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านตามข้อ 7.4
7.7. สิทธิในการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง
ท่านสามารถตรวจสอบได้ว่าข้อมูลส่วนบุคคลของท่านมีความเป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด และหากท่านเห็นว่าข้อมูลส่วนบุคคลใดที่เกี่ยวกับท่านไม่เป็นปัจจุบัน ไม่สมบูรณ์ หรือก่อให้เกิดความเข้าใจผิด ท่านสามารถขอแก้ไข เปลี่ยนแปลง หรือลบข้อมูลส่วนบุคคลนั้นได้
7.8. สิทธิในการยื่นข้อร้องเรียน
กรณีที่ท่านพบ เห็นการละเมิดหรือฝ่าฝืนนโยบายคุ้มครองข้อมูลส่วนบุคคลของบริษัท หรือเอกสารฉบับนี้ ท่านสามารถแจ้งเหตุการละเมิดหรือฝ่าฝืนได้ที่ ผู้ควบคุมข้อมูลส่วนบุคคล (Data Controller) ทางอีเมล [email protected] นอกจากนี้ ท่านยังมีสิทธิร้องเรียนกรณีฝ่าฝืนหรือไม่ปฏิบัติตาม พ.ร.บ.คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลตามหลักเกณฑ์ที่กฎหมายกำหนด

Employee Privacy Notice
Preamble
This Employee Privacy Notice is applied to your personal data collected by Ek-Chai Distribution System Co., Ltd. (the “Company”) including existing personal data that you agreed to the Company to collect, use and disclose (if any) and any personal data to be collected in the future under conditions of this notice.
The Company recommend you to read and understand this Employee Privacy Notice as it explains you how the Company handles with your personal data including how to collect, use, disclose or other method, whether automatically or not, such as to record, manage system, retain, modify or transform, retrieve, transmit, transfer, disclose or make data usable or accessible, sort, combine, prohibit or limit access, delete or destroy (“Process”) and informs you for the purpose of Process, retention period of your personal data and your rights as details below.
1. Scope of this Employee Privacy Notice
This notice applies to all types of employees and third-party which relates to you such as your family members, emergency contact persons, reference persons. In addition, if you disclose the third-party’s personal data to the Company, it shall be deemed that you have already complied with the applicable law including receipt of consent from the third-party.
2. Respect of Employee’s Privacy
The Company respects of your privacy, concerns of your personal data protection and is aware that you, as the Company’s employee, may expect that your personal data shall be secured and used as the Company’s purpose only.
In addition, the Company has the measure for information security including protecting unauthorized persons to access or use of your personal data unlawfully.
In the event of your personal data collected prior the effectiveness of the law, the Company will collect and use your personal data in accordance with the same purposes announced to you. In this regard, you have the right to withdraw your consent by contacting the Company as details set out in Clause 8 of this document.
3. Collection and Receipt of Your Personal Data
3.1. The Company collects and receives your personal data from the following channels:
(a) Personal data that you directly disclose to the Company
You may disclosure your personal data to the Company directly such as application form, employment agreement and other supporting documents which you deliver to the Company at the stage of job application. In this regard, you may disclose third-party’s personal data such as family members (father, mother, spouse, children), emergency contact persons, and/or reference persons. The Company use these data for human resource management, providing privileges to you as the Company’s employee and/or contacting in case of emergency.
(b) Personal data that the Company automatically collects from you
The Company collects your personal data automatically through various channels such as Cookies or other similar technology.
(c) Personal data received from third-party
The Company may receive your personal data from third-party including recruitment agency (If you apply the job from the recruitment agency, please also read the recruitment agency’s privacy notice.), ex-colleague or ex-employer, verification of your profile by lawfully applicable method, or other companies under Charoen Pokphand Group (details thereof mentioned in the list of Charoen Pokphand Group attached herewith).
3.2. In case of collecting your personal data, the purpose and details as set out in this privacy notice shall be informed to you including without limitation to legal basis for collecting, using or disclosing and/or Process of personal data. If your prior consent is required, the Company will request for your consent expressly and will Process of your personal data once the Company receives your consent.

In case that your job description is required more personal data to be Processed, the Company may collect and use additional personal data. The Company may collect sensitive data by requesting your prior consent for the purpose of employment.
The Company collects your personal data including your documents having personal data during your employment and 10 years after your termination of employment unless the law specifies longer period to retain. After the retention period passes, your personal data will be destroyed in accordance with the Company’s process.
4.2. Purpose for collecting, using, disclosing and Process of personal data
The Company may refer to legitimate interest, legal obligation, contract and consent basis for Process of your personal data. For Process of sensitive data, the Company will refer to consent basis unless the exception specifies in Personal Data Protection Law.

The Company is required to Process your personal data for some purposes referred to legal basis (legal obligation or contract). If you do not want the Company to Process your personal data, there might be legal affects or the Company may be unable to perform the obligation under the contract or may not engage you (if any) resulting in the Company rejects to enter into the contract with you or cancel the services provided to you whether wholly or partially.
In the event that any Process of your personal data is different from the purposes as mentioned above, the Company will revise and announce the updated privacy notice to explain such new Process.
5. Disclosure of Personal Data to Third-Party
To comply with the purpose of collection, use and/or disclosure of the above matters, the Company may disclose your personal data to
1. Companies under Charoen Pokphand Group (Lists of companies under Charoen Pokphand Group are in the attachment.)
2. Outside organization related to the employment and employees’ welfare such as insurance company, company making employee’s card or name card, bank which you use for payroll, hospital or clinic for medical expenses provided by the Company, and government agency.
The disclosure of your personal data to third-party will be complied with the purposes specified by the Company or by law. In case that the law requires your consent, the Company will request for your consent prior disclosure of your personal data.
If the Company discloses your personal data to third-party, the Company will have the suitable measurement in accordance with the law to protect your disclosed personal data. In addition, if the Company transmits or transfers your personal data outside Thailand, the Company will ensure that the destination country, international organization or receiving person living outside Thailand has the sufficient measurement to protect your personal data. In some cases, the Company may request your consent prior transmission or transfer of your personal data outside Thailand.
6. Retention Period for Collecting of Personal Data
The Company retains your personal data only to achieve the specified purpose of Process. The retention period may be changed depending on the purpose of collecting personal data. In addition, the Company will collect the personal data as long as the law specified and business purpose.
7. Right of Data Subject
7.1. Right to withdraw consent
If you provide consent to collect, use, or disclose of your personal data, you have right to withdraw such consent.
7.2. Right to access personal data
You have right to request for access and receipt of your personal data collected by the Company including request to disclose how to receive such data.
7.3. Right to transfer personal data
You have right to request for transmission or transfer of your personal data to you or other data controllers unless the transmission or transfer cannot be done subject to the law.
7.4. Right to object for Process of personal data
You have right to object to collect, use and disclose of your personal data as the following circumstances:
7.4.1. The Company collects your personal data with the exemption to consent requirements as the purpose of use is for public interest, legal obligation, or legitimate interest unless the Company has a compelling legitimate ground to Process or the Company’s collection, use or disclosure of such personal data is carried out for the establishment, compliance or exercise of legal claims, or defense of legal claims.
7.4.2. The Company collects, uses, or discloses your personal data for direct marketing.
7.4.3. The Company collects, uses, or discloses your personal data for scientific, historical or statistic, unless it is necessary to performance of a task carried out or reasons of public interest by the Company.
7.5. Right to erase personal data
You have right to request for deletion, destroy or de-identification of your personal data for the following circumstances:
7.5.1. Your personal data is no longer necessary in relation to the purposes for which it was collected, used, or disclosed.
7.5.2. You have withdrawn consent on which the collection, use or disclosure is based on, and where the Company has no legal basis for such collection, use or disclosure.
7.5.3. You have successfully made an objection to collect, use or disclose of your personal data and the Company cannot reject to such request.
7.5.4. Your personal data have unlawfully Processed.
7.6. Right to restrict use of personal data
You have right to restrict the use of your personal data for the following circumstances:
7.6.1. The Company is in the process of investigation of the validity or accuracy of data.
7.6.2. Your personal data has been unlawfully collected, used, or disclosed.
7.6.3. Your personal data is no longer necessary to retain for the purpose of collection, used, or disclosure under this notice.
7.6.4. The Company is in the process to verify your request to reject the objection to collect, use or disclose your personal data as mentioned in clause 7.4.
7.7. Right to rectify your personal data
You have right to check whether your personal data is up to date, valid and correct or not. If you consider that your personal data is not up to date, invalid or incorrect, you can request for amendment, modification, or deletion of your personal data.
7.8. Right to file a complaint
If you find any breach of personal data or violation of this privacy notice, you can report to data controller via email: [email protected] Subject to the law, you can file a complaint related to violation of Personal Data Protection Act B.E.2562 to Personal Data Protection Commission (PDPC).
You can exercise your right (clause 7.1.-7.8.) by filling in the Data Subject Request Form and sending to the email set out in Clause 8 below or other channels which the Company may further inform you. Please note that you may tentatively modify your personal information or withdraw some type of consent on iTouch.
